Please read these terms carefully before using our services.

1. Delivery of Services
DmcaQloud agrees to furnish services to the Subscriber, subject to the following Terms of Service (TOS).
- use of DmcaQloud Service constitutes acceptance and agreement to DmcaQloud's AUP as well as DmcaQloud's TOS (Terms of Service).
- All provisions of this contract are subject to the TOS (Terms of Service) of DmcaQloud and AUP (Acceptable Use Policy).
- The AUP may be changed from time to time at the discretion of the Company. Subscriber understands that change to the AUP by the Company shall not be grounds for early contract termination or non-payment.
2. Use of Services
You may use our services, provided that you are of legal age to form a binding contract and are not barred from receiving such services under the laws of your jurisdiction.
2.1 Resources & Bandwidth
- Web hosting accounts are prohibited from hosting file distribution sites (warez, iso, movie download sites, etc).
- Dedicated servers have unmetered bandwidth as specified in the plan.
- Fair usage policy applies to "unmetered" offers to ensure network stability for all users.
2.2 Prohibited Activities
- Spamming (sending unsolicited commercial email).
- Hosting of Phishing/Scam pages.
- DDoS attacks initiated from our servers.
- Botnets/C&C servers.
- Child Pornography (CSAM) is strictly prohibited and will be reported.
2.3 Security & Updates
- You are responsible for maintaining the security of your account and servers.
- DmcaQloud is not responsible for any security compromises that result from your failure to update software or secure your credentials.
3. Fees, Payments & Invoicing
All fees and charges are non-refundable unless otherwise stated.
3.1 Payment Terms
- All payments are due on the anniversary date of the service.
- We accept Crypto (Bitcoin, Monero, USDT), Credit Cards, and PayPal.
- Services may be suspended if payment is not received within 3 days of the due date.
3.2 Cancellations
- Cancellations must be requested via the client area at least 24 hours before the renewal date.
- Failure to cancel will result in the generation of a new invoice.
4. Refunds & Warranties
- Usage of bandwidth or resources is not refundable.
- Cryptocurrency payments are non-refundable due to exchange rate volatility.
- We offer a 3-day money-back guarantee for technical failure of the service only (not for changing your mind or AUP violations).
5. Intellectual Property Rights
We respect the intellectual property rights of others.
- We are a DMCA ignored host, meaning we do not process DMCA takedown requests from third parties.
- However, we do not tolerate the hosting of stolen data or content that violates Dutch law.
- Trademarks and copyrights remain the property of their respective owners.
6. Limitations of Liability
DmcaQloud shall not be responsible for any claimed damages, including incidental and consequential damages.
- DmcaQloud disclaims any warranty or merchantability or fitness for a particular purpose.
- This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by DmcaQloud and its employees.
7. Governing Law & Disputes
This agreement shall be governed by the laws of the Netherlands. Any dispute arising from this agreement shall be securely resolved in the jurisdiction of Amsterdam courts.
